Thank you for joining our online community portal (the “Community”). The purpose of this portal is to keep you up-to-date with the progress of our construction projects with daily information from our contractors.

We created this portal so that you can follow the projects that matter to you, comment on the progress, add your own views, questions and pictures of the work as it proceeds.

Who we are

This Community Portal is provided by NWG, a regulated water and sewerage business operating in the north of England as Northumbrian Water, and in the south east of England as Essex & Suffolk Water. NWL´s registered company number is 2366703 and its registered office is at Northumbria House, Abbey Road, Pity Me, Durham, DH1 5FJ.

Definitions

  • “We”, “us” and “our” refers to NWL, or any member of the Northumbrian Water (“NW”) group of companies.
  • “You”, “your” and “yours” refers to you, the person using NWL´s Community or website.
  • “Website” means any website under the ownership or control of NWL or any member of the NW group of companies including the website which hosts the Community.
  • “Content” means everything contained in, or accessible from, this website which has been produced by NWL or any member of the NW group of companies.
  • “Postings” means all information, data, artwork, text, photographs, videos, messages and any other material which any user posts on, uploads to, or otherwise makes available to the Community.

Ownership of Content

All Content provided by NWL, whether via the Community or the website, is protected by applicable intellectual property rights. We reserve all our rights in relation to this Content. Where we license any content from third parties, we acknowledge this.

If you would like to create a text link to our website from your own, you do not need any permission for this. However, we reserve the right to require you to remove any such link (if we do not feel that it is appropriate).

Posts

You are responsible for everything which you post on, upload to, or otherwise make available to NWL´s Community (“Your Postings”). If you did not create this yourself, you are responsible for obtaining the owner´s consent to use it on any NWL site.

NWL´s Community works best when users can share, and access, each others´ postings. You are welcome to upload Your Postings as you wish. In order to share fully, and make the Community a success, we need your permission to make Your Postings available to other users. By using the Community you agree to grant us a worldwide, royalty-free licence to use Your Postings. This licence will not be exclusive to us, in that you can allow other people to use the material too. The licence is also transferable in that the material can be used by, for example, other site users, or contractors of NW companies.

For content that is covered by your intellectual property rights, like photos and videos (IP content), you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content in Your Postings. This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it. When you delete IP content, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

When you publish Your Postings, it means that you are allowing everyone, including people on our forum, to access and use that information, and to associate it with you (i.e., your account details like name and profile picture).

We always appreciate your feedback or other suggestions about our Community Portal, but you understand that we may use your feedback or suggestions without any obligation to compensate you for them (just as you have no obligation to offer them).

We reserve the right to remove any of Your Postings that contain, for example, any of the following content:

  • Unauthorised commercial communications;
  • Viruses or other malicious code;
  • An attempt to gain login information or access an account belonging to someone else;
  • Bullying, intimidation, or harassment;
  • Hate speech, threats, or pornography; anything that incites violence; or contains nudity or graphic or gratuitous violence;
  • Alcohol-related, drug-related, dating or other mature content (including advertisements);
  • Anything unlawful, misleading, malicious, or discriminatory;
  • Anything that could disable, overburden, or impair the proper working or appearance of our website, such as a denial of service attack or interference with page rendering or other functionality; and
  • Personal information about a person other than you.

Personal information (“persona data”)

By browsing these pages, joining and using the Community, you give us consent to use your personal information.

We will collect the following personal information about you:

  1. Your profile information, supplied by you to set up your forum account (name, user name, email address(es), telephone number(s), password(s), ‘avatar´ picture);
    1. In order to keep your personal information safe, we would recommend that you choose a username for the Community which is not linked to your own name, and that you do not include any personal information, whether about yourself or someone else, in Your Postings.
  2. Your forum account administration data (e.g. tailored favourites);
  3. All the comments, information, documents/photos* your post to the forum; and
  4. All the comments, information, documents/photos posted to the forum that identifies you.

We will only use your personal information and other data we collect from you on this forum to run the forum, assess its performance and success, and to contact you directly concerning any issues you raise that we feel would be better addressed outside of the forum.

We treat your personal information with great care, and have an extensive data protection compliance programme throughout our business. Our Privacy Statement explains in more detail how we deal with information relating to our customers and other people and companies we deal with.

You need to be aware that, if you include any personal information in Your Postings, it may not be secure.

You agree to indemnify NWL and any relevant third party against any claim or proceeding which is related to any personal information in Your Postings.

Sharing your information

Our Community Portal is provided with the help of Its Stonbury (http://www.itsstonbury.co.uk/) and so we will share with them the data, including the personal information you supply necessary to administer the website.

Our liability

While we host the Community we are not responsible for the content of the Postings, which are provided by site users. We can have no liability for any losses or damage which are in any way related to the content of these Postings.

Your liability

If anyone notifies us that anything in Your Postings has infringed their intellectual property rights, we may withdraw any, or all, of Your Postings immediately, in order to investigate such claims.

If anything in Your Postings is found to have infringed another party´s intellectual property rights, and we suffer any losses or damages as a result, you agree to indemnify us against all claims and proceedings arising from such infringement.

Disputes

You are responsible for how you behave towards other users of NWL´s Community. While NWL will act as site moderator, and will monitor any disputes between individual users, we cannot be responsible for resolving them.

Suspension, withdrawal and termination

We reserve the right to suspend or withdraw the Community at any time without notice. Equally, we reserve the right to suspend or terminate your individual account at any time. While we will try to explain our reasons for doing so, it may not always be possible to provide such an explanation at the same time as the suspension or termination.

Governing law

These Terms are governed by, and will be interpreted in accordance with, English law. Any dispute relating to them, or your use of NWL´s Community, or website, will be subject to the exclusive jurisdiction of the English courts.

Changes to Terms

From time to time, we may make changes to these terms and conditions. This will be done without any specific notice, but we will always put the date of the latest revision at the end, to help you.
